Eldoret-based lawyer Duke Nyamweya was charged in a Nakuru court for alleged illegal sale of land belonging to former President, Daniel Moi.

Nyamweya is accused of receiving Sh2.5 million on November 17 2015 from David Cheruiyot Rono as part of payment of the 100 acre piece of land.

He is further facing charges of illegal forgery of signatures of Shamila Chepkemei on November 16 2015 in a land sale agreement of plot number NAKURU/OLENGURUONE/KIPTANGICH/1, registered to Ismael Chelang'a.

The court heard that the complainant saw the piece of land and deposited the Sh2.5 million in the bank account of the accused and promised to pay the rest within 90 days.

When Rono knew the land belongs to former President he asked for the refund but never received it.

Nyamweya was represented by lawyer Haron Kibet who told the court that he had lost his mother on Tuesday.

The prosecution led by state counsel Hillary Sungoiyo accused the defense of interfering with witnesses to derail the case.

“The accused is interfering with the prosecution witness with intent to derail this case. The Director of Public Prosecution Nakuru office had asked the accused to appear before court today which he did not observe,” Sungoiyo said.

Sungoiyo asked the court to forfeit Sh100, 000 Police bail granted to the accused and issue a warrant of arrest against the accused. He also asked the defense to provide proof that the accused is indeed bereaved.

The defense counsel said the prosecution failed by procuring fake officers to investigate the matter.

“The investigating officers are impersonating to be officers and were demanding bribe from the accused. They harassed him at his office in Eldoret,” Kibet told court.

The prosecution failed to address the court on investigation officers who are impersonating.

Nakuru Chief Magistrate David Kimei ruled that the bail be forfeited to the state and Nyamweya be issued with an arrest warrant for contempt of court. The case will be mentioned on July 19.
