Lawyer Apollo Mboya has filed a petition to bar government advertisements on TV during this elections period arguing that the advertisements that have been running for the past four years were in contravention of section 14 of the elections offenses act.

Apollo wants the court to declare the advertisement of different projects and programs undertaken on the www.delivery.go.ke as illegal and unconstitutional.

Mboya wants the court to declare that the refusal or delay by the DPP to exercise his constitutional powers to investigate and prosecute those responsible for the offenses under the Election offenses Act be declared illegal irregular, unlawful and unconstitutional.

He also wants a permanent injunction to be issued against the government and its agents from advertising the achievements by the national government in the delivery portal, or any print or electronic media or by way of banners in public places during this time of elections.
