Miguna's lawyer Nelson Harvey has suffered a blow in his bid to be the chair of the influential Law Society of Kenya(LSK).
This is after the High Court ruled that he had not attained the requisite 15-years experience required of candidates seeking to contest the presidential elections of LSK.
Speaking today at his Parklands' office, the lawyer who also doubles up as a socio-political commentator said that he intends to file a notice of appeal to challenge the decision, calling it unfortunate as it will lock out young lawyers.
''We have already filed a notice of appeal and we propose to be in the Court of Appeal tomorrow because this is not a blow to Nelson Havi. This is a blow to the young lawyers. The decision does not resonate well in a democracy. We need to have a change because we cannot afford to have the status quo,'' Nelson Havi said Monday night.
The lawyer has been involved in efforts mounted to have outspoken lawyer Miguna mIguna released from detention.
He lashed out at the state for the continued detention of his client, saying that it had acted in contempt of court.
''That is a serious violation of his rights given that a court had already issued an order for him to be released but that has not yet happened. This does not augur very well for the country. It is incumbent upon the government to comply with court orders,'' Mr. Havi said.
