Lawyer Danston Omari now says that the government will now have it even harder deporting opposition's National Resistance Movement (NRM) leader Miguna Miguna.

In an interview on Radio Citizen Wednesday, the lawyer observed that Miguna has outsmarted the nation's immigration department in a mental and legal game.

According to the international boundaries law, he said, a person considered stateless, as the department has since referred to Miguna, should not be allowed to set even a single foot in a nation's territory, failure to which ousting him will be tideous.

"Miguna was well aware of the law hence his move to force his way into the airport. The immigration officers failed to prevent him from stepping out of the no-man's-land and deporting him again can now only be done by the court," said the lawyer.

With the department having unsuccessfully tried to force the vocal barrister into a plane to Dubai earlier, Omari blamed that on the respective officials' poor law translation.

"The state went overboard in its earlier attempt to turn him back as that is almost impossible. Miguna is aware of that, hence his refusal to board the plane as he would rather be presented in court where he stands a high chance of winning basing on his pending case on the same matter," he added.

Miguna landed in the country on Monday from Canada but has since been barred from entering the nation and is being held at the Jomo Kenyatta International Airport (JKIA).

He was deported to Canada in early February with  his lawyers' attempts to free him also proving futile.
