Kenyans must be prepared to live with the existing Independent Electoral and Boundaries Commission bosses and have an election or kick out them out and end up with no new team to oversee the August 2017 polls, a Nairobi-based lawyer has warned.
On Sunday, lawyer Steve Mogaka argued that a judicial process would ensue in case the commissioners are forcefully ejected out of office.
"As we burn out in the street demos against the IEBC, I am constrained to think loudly. If IEBC commissioners are removed in a manner not prescribed by law as outlined in Article 251 of the constitution, they have a right to challenge their removal and to block any other person from filling and or occupying their positions," he said.
"The courts will surely reverse their ouster and grant an injunction against the removal or replacement of the commission. This results in us having no new commission before August 2017," he added.
Mogaka who is eyeing the West Mugirango constituency seat spoke Sunday during funds drive at Masosa Secondary School.
The opposition Coalition for Reforms and Democracy (Cord) has been leading nation-wide demonstrations, calling for the removal of the IEBC commissioners.
It argues that the commission as currently constituted, cannot be trusted to conduct free and fair elections.
