Before the sentence ruling, the victim had told the Court in camera that the accused Gilbert Kebenei had on several days enticed him with sweets before committing the crime against him on the evening of July 30, 2014 at Mosop Village in Molo sub-county within Nakuru County.

Senior Resident Magistrate James Mwaniki who presided over the case in a packed Court was told by the Prosecution that a neighbour of the minor’s family who was on her way to a local market centre witnessed the sexual offence incident that took place at a maize plantation in the Village.

The witness, according to the Prosecution Desk, had heard the victim crying before venturing into the maize farm to establish what was transpiring. However the accused whom the witness identified had fled.

In the ruling the Magistrate noted that there was enough evidence that had been gathered by the Prosecution and affirmed by the victim himself and witnesses to charge the accused with the immoral and inhuman acts against a minor which are against the penal code of the Kenyan Law.

The accused was given fourteen days to appeal to the ruling.
