Speaking to KTN News shortly after the High Court declared his deportation to Canada illegal, Miguna said that he has instructed his lawyers to file suits against Interior Cabinet Secretary Fred Matiang’i, Inspector General of Police Joseph Boinnet, Director of DCI George Kinoti and Attorney General Githu Muigai over what he terms as illegal arrest and deportation.

“I will also sue Said Kiprotich who is the Head of Flying Squad, and one Mr Njoroge for acts of human rights violation committed against me,” he said.

Miguna further stated that he will make a trip back to Kenya from Canada immediately the ruling by Justice Luka Kimaru is complied with by the government.

“I am coming home within the purview of the court order by the despots in Nairobi,” he said.

“If they are not able to comply with this court order then there is no need for the judiciary to exist. They should just down their tools. If a government chooses which orders to obey and which ones not to obey then we have no basis for taking legal disputes to court.”

Meanwhile, the government through the Interior Ministry has said it will appeal the decision by Justice Kimaru.

In a statement, Interior PS Karanja Kibicho said while the government respects the court’s decisions, it will file an appeal at the Court of Appeal instituting that Miguna’s deportation was done in accordance with the law.
