3:25 pm: "The respondents have violated article 10 of the constitution," Judge Odunga.

                 "Each of the respondents must pay a penalty of Sh200,000 personally, the amount must be deducted from their next month's salaries," Judge Odunga.

3:23 pm: "The respondents have clearly shown that they do not respect court orders," Justice Odunga.

3:20 pm: Court session resumes, Judge Odunga delivering his ruling.

1:53 pm: Justice Odunga to make a ruling on the applications today at 2:30 pm.       

               Lawyer Mutinda speaks

1:46 pm: "My Lord, I had submitted to this court that I did all I could to ensure that the respondents appear before you. The application to declare me in contempt of court is a direct threat to me, a violation of my rights and an attempt to intimidate me. Since when did I become a subject of this proceeding?" Mutinda tells the court.

               "Arrest Matiang'i"

1:41 pm: Orengo asks the court to allow Kenyans to arrest the three respondents, who he says are in contempt of court. 

1:35 pm: Miguna's lawyer Harun Ndubi asks the court to direct the government to facilitate his client's travel to Kenya from Dubai.

Ndubi, in his submission, asks the court to find lawyer Mutinda in contempt of court, and sentence him to jail.

1: 23 pm: Orengo asks the court to direct the immigration department to process a new Kenyan passport for Miguna Miguna, and hand it to lawyer Nelson Havi.

 1:20 pm: "My Lord, this court should direct that an officer from the Kenya National Commission on Human Rights be facilitated by the government to travel to Dubai to take care of Miguna's situation," Orengo says.

1:15 pm: "My Lord, your order should be specific, that the respondents be locked up at the Kamiti Maximum Security Prison by 2 pm, tomorrow," Orengo asks Judge Odunga in his submission.          

                ODM speaks 

1:11 pm: ODM party asks Kenyans to arrest on sight CS Matiang'i, IG Boinnet and Kihalangwa. The party also wants Chief Justice David Maraga to deny the three an audience in all court.

1:09 pm: Orengo asks Justice Odunga to sentence Matiang'i, Boinnet and Kihalangwa to six years each in prison.

1:05 pm: Miguna's lawyer James Orengo, "My Lord, each act of disobedience must be treated separately, and each must attract the maximum sentence."

1:00 pm:   "Miguna Miguna is a politician and a lawyer by profession. He has vied for elective positions, he has a following, and his followers will not receive it well that their leader has been deported out of the country twice. This is a potential cause of violence. My Lord, this court hates violence and should make sure there is no chaos in this country. Let Miguna come back, and this court should make coercive orders," Khaminwa says.

12:52 pm: "They might not be jailed, but the ruling will remain in the books of history, and they cannot continue to hold public offices," Khaminwa tells the court in reference to CS Matiang'i, IG Boinnet and Immigration chief Kihalangwa.

12:45 pm: Lawyer Khaminwa asks Judge Odunga to declare Matiang'i, Boinnet and Kihalangwa's lawyer guilty of contempt of court.

"We have to bring discipline in the administration of Justice. My Lord, you must issue an order to bar Mutinda from appearing in any high court of law," Khaminwa.

12:40 pm: "Mutinda is assuming that we are people of low intellect, he thinks he can come here and lie to this court and get away with it. It is quite clear that he has not discharged his duties," Khaminwa tells the court.

12:33 pm: Miguna's lawyer Dr. John Khaminwa dismisses Mutinda's claims that he cannot reach Matiang'i, Boinnet and Kihalangwa.  

"Who was giving Mutinda instructions on the affirmance in the affidavits? Mutinda has made no efforts to visit the offices of the respondents," Khaminwa.           

12:30 pm: Matiang'i, Boinnet, and Kihalangwa fail to appear in court. Their lawyer, Charles Mutinda, says he is unable to reach them and they are not in their offices. 

"My Lord, I am unable to reach my clients, they are not in their offices. I leave it to this court to make decisions," Mutinda.

Ultimatum

High Court Judge George Odunga has given Interior Cabinet Secretary Fred Matiang’i, Immigration boss Gordon Kihalangwa and Inspector-General of Police Joseph Boinnet one hour to appear in court for sentencing.

The trio was convicted for contempt of court on Wednesday after they disobeyed orders to release fiery lawyer Miguna Miguna from detention.

Miguna was on Wednesday night deported to Dubai, despite a court order that he be released unconditionally.

He had been detained at the Jomo Kenyatta International Airport (JKIA) since Monday 2:30 pm when he jetted in.

Judge Odunga ordered that Matiang’i, Boinnet, and Kihalangwa appear in court today at 10 am, but they failed to show up.

Thursday, Judge Odunga asked the convicts’ counsel to contact them and make sure they are in court by 12:15 pm today.

National Super Alliance (Nasa) leader Raila Odinga, businessman Jimi Wanjigi, and Professor Makau Mutua were at the Milimani Law Courts in solidarity with Miguna.
