Peter Wafula and David Nyongesa have sued Bungoma Governor who is the party leader for advertising the party merger with the Jubilee.

Secretary General, Benjamin Mwema has also been sued.

According to the complainants, Lusaka and Mwema illegally advertised the party merger yet they are not officials and their move is detrimental to party officials and its members.

They now want the political parties Tribunal to issue a temporary injunction barring te merger which is set to be made official on September 8,2016.

They further want Political Parties to register the interim members appointed during the meeting held in Bungoma on August 8, 2016, as the official party members.
