Former Parliament Deputy Speaker Farah Maalim at the past. [Photo/Standard] A Garissa court has granted permission to the former Garissa township MP aspirant Farah Maalim to file additional affidavits in an election petition against Garissa Township MP Aden Duale.

Judge Hedwig Ongudi allowed Maalim to file further affidavits in 14 days. 

IEBC has 7 days to file a response.

Maalim, through his lawyers, told the court that IEBC had not served them with their response by Wednesday. 

The lawyers confirmed that they had received Duale's response.

Maalim filed the petition after he lost in the elections citing that Duale was not validly elected since the August 8 poll was flawed.

Maalim wants the court overturn Duale's win and order IEBC to conduct fresh elections.

He accused IEBC of committing election irregularities such as allowing Duale’s supporters to vote more than twice since they were not marked with indelible ink after they had voted.

Farah said the election laws were violated due to the double voting and the long delays by IEBC discouraged his supporters thus didn't vote. 

Duale has maintained that he won fairly.
