Wiper party deputy party leader Farah Maalim has pointed out that the judgment from the Supreme Court can favor either Raila Odinga or Uhuru Kenyatta by considering the substantive evidence provided or the election technicalities in the August 8th elections.

According to Maalim, the judges bench will have to consider the evidence provided by both parties or the technical issues that may have affected the whole presidential election.

"The Supreme Court has the option of making a judgment considering either the substantive evidence before them or consider technical issues associated with the whole presidential election. Just as was in 2013 where technicalities were considered, so will the current judges base their judgement on either the evidence or technicalities in this year''s petition," said Maalim.

However, Maalim reiterated that the timeline set for the judgment is too limited.

He faulted both NASA and Jubilee legislators for failing to come up with constitutional amendments that may have prolonged the timeline to at least 30 days.

Maalim nonetheless said that NASA should have collected at least 1 million signatures for the process since attempting such a move in parliament would have been thwarted by the tyranny of numbers.

"Both NASA and Jubilee failed Kenyans by not coming up with constitutional amendments aimed at widening the timeline set for a presidential petition. In fact NASA should have been more vocal on this by even collecting a million signatures considering a parliamentary move would have been thwarted by the tyranny of numbers," added Maalim.
