Garissa Township MP Aden Duale’s likelihood of losing his seat has increased after the court allowed Former National Assembly Deputy Speaker Farah Maalim to file additional affidavit seeking for the nullification of the August general elections. Maalim had moved to court on the grounds that the election was not conducted as per the constitution.
He cited massive irregularities and illegalities including deliberate delays.Justice Hedwig Ongudi allowed Maalim to file the extra material in 14 days.
In his ruling, Ongudi ordered the Independent Electoral Boundaries Commission (IEBC) to file its response within 7 days to allow for the smooth running of the case against it and Duale, a strong defender of the Jubilee government.
According to Maalim’s lawyers they have only received the response from the Duale’s team and not IEBC. The Wiper politician argues that Duale was not validly elected and there is need for a fresh election in the area.
He further states that the violation of the laws governing the election made the outcome not to reflect the will of the residents of Garissa.
