In the ongoing Machakos town constituency petition in the Machakos high court against legislator Victor Munyaka, the petitioner, Albanus Mutisya early today told the court that the Machakos town MP used public resources to campaign.
Albanus, Mutisya, who is the former KNUT secretary-general is the petitioner in the suit questioning the area MP’s Victor Munyaka misconduct with the public funds during the campaign season.
“The buses that were allocated funds 7 months earlier to the August 8 polls were not used as they were meant to be used. Hon. Munyaka went ahead to use the buses for his own campaign instead of letting the schools meant to benefit from them use them. Munyaka even threatened the schools who benefited from the CDF-funded buses saying that they would pay for their own buses if they would fail to vote for him,” Mutisya told the court.
The case which is appearing before Justice David Kimei is blocking the election of Machakos town MP Dr victor Munyaka.
Munyaka’s lawyer Stephen Makundi said that his client has confirmed to the court that the whole election process for the area Member of Parliament was flawless and thus a re-election is all the petitioner wanted the court to grant, which according to him, the petition is unmerited.
The petitioner’s witnesses had captured photos of the third respondent Hon. Victor Munyaka commissioning the buses during the campaign period to serve in his campaigns, which, according to him, was illegal as per the election act.
