Maendeleo ya Wanaume chairperson Nderitu Njoka has criticised the recent ruling by Justice Mumbi Ngugi regarding the compulsory inclusion of a father's name on birth certificates of children born out of marriage.

Mr Njoka has now issued an 11-day ultimatum to the Chief Justice Willy Mutunga to overturn the directive, failure to which they will seek legal action.

On Monday, Nderitu said the directive was unconstitutional and that it will give exploitative women a chance to fake parenthood and take advantage of the men.

'This ruling is ready meat for gold-diggers who may chose to use it selfishly. We do not object this verdict on the case of any single mother who challenges the law. This is the very first time that our Constitution is violated in broad daylight by the High Court single highhandedly,' noted Njoka.

Njoka further said the High Court judge overstepped her legal mandate by declaring the section in the Registration Act unconstitutional, noting that such an issue ought to have been taken to Parliament for discussion.

Justice Ngugi in her ruling had directed that any new born child should have the father's name indicated in the birth certificate upon birth even without his consent, regardless of whether the parents are married or not.
