The October 26 repeat presidential election in which President Uhuru Kenyatta was declared the winner was unconstitutional, an Opposition official has said.

According to Norman Magaya, the NASA CEO, Uhuru was illegitimately elected as the electoral commission went against the Constitution in conducting the poll last week.

He said the poll went on in disregard to the apex court ruling of 2013 that provided for parties to go to fresh nominations in case of a fresh election.

"What happened on the 26th was not an election and will never be one, so the results don't count for anything to the people of Kenya," he stated.

In an opinion piece published by The Standard, Magaya accused the Jubilee administration and IEBC of colluding to 'steal power in the eyes of every Kenyan'.

"Jubilee is in a rush to get access to power and public resources when Kenyans have actually rejected them as expressed in the low turnouts. What happened at Bomas was cooking of numbers to give Jubilee a semblance popularity," he said.

The Opposition official further said Jubilee was acting like an occupational force in ruling the country, accusing the Government of using police to shut dissenting voices.

"We will not allow them get away with this fraud in the name of an election. Among the many options we can pick, is engaging in civil disobedience with the key of bringing the culture of election stealing to an end," Magaya said.

"We will not sit down and be treated as second-rate citizens in our nation after 54 years of independence," he added.
