A 50-year-old Ugandan, who has been operating in the country illegally as a magician was on Monday arraigned in a court in Nakuru, to face charges of entering and staying in the country illegally.

The accused, Mofat Kitovi, the preceding Chief Resident Magistrate Felix Kombo was told, entetred the country in November 3 last 2014 as a visitor, but has since been involved in an illegal business and being in the country illegally.

The prosecution told the court that the accused was arrested in Kaptembwa estate in Nakuru West town by police officers from Nakuru Central Police Station, following a tip off by Criminal Investigations Department officers.

According to the prosecution, the accused had rented a business premises at Kasptembwa trading centre, where he lived and operated a traditional clinic without a license from the government.

In mitigation, after pleading guilty to the offenses, the accused said he was in a process of applying for permanent stay permit from the immigrations department, and a license from the government to operate a traditional clinic when he was arrested.

The court ruled that the accused heightens his permits and registration process in a period of 14 days, and fined him Sh20,000 for the offenses.
