The Magistrate who released widow of slain Muslim cleric Aboud Rogo has been accused of not considering the nature of the case.
Assistant Director of Public Prosecutions Alexander Muteti said that the release of Haniya Saggar would jeopardize the case in which he accused of talking to terror suspects just before the attack on the Mombasa police station.
Muteti argued before Justice Dora Chepkwony that Saggar could interfere with witnesses.
“The magistrate should not take the children of the late clergy as an excuse to grant her bail while putting to risk, lives of millions of Kenyans at the expense of a few children who can be taken care of by relatives,” he said.
He further said that the suspect was a flight risk and that investigations onto her alleged link with three females, who carried out the attack, were still ongoing.
