A woman whose daughter was allegedly defiled was on Friday ordered to present her before the court or risk being put behind bars.
Elizabeth Mogere was given the directive by Kisii Senior Principal Magistrate Nathan Shiundu after she failed to present her 14 year-old daughter to testify on several occasions.
The court have had several adjournments of the case as Elizabeth had claimed that her family was worried that her daughter would never find justice in court.
She said her fears followed the court’s decision to free the suspect Reuben Ndubi from custody a move she said had put her family’s safety in jeopardy.
Mogere further claimed the suspect who is well known to the family had made several threats to them after his release.
But her claims were overruled by the magistrate who accused the complainant of giving lame excuses that could not be substantiated.
He explained to her on the need to obey court orders and further said if there had been threats to her family, she should have raised the matter before the court.
“You cannot purport to defend your failure to obey court directives on such flimsy allegations. If threats were made to your family, such matters should have been addressed had you raised them in court,” he said.
The court finally adjourned the matter and ordered the case to come up for hearing on May 8, the same day the victim is supposed to testify on the matter.
Ndubi is accused that on March 7, 2017 and while at Menyinkwa sub-location in Kisii County, he sexually assaulted the minor who is a primary school pupil.
The prosecution is planning to line up three key witnesses to testify in the case.
