A Mombasa based magistrate has refused to withdraw himself from a case involving a man that has been linked to various fraudulent activities in the Coast region.Senior Principal Magistrate Henry Nyakweba told the accused, Rajab Mwamchera Shanan, that he will not remove himself from the case just because he failed to release him on bond.This comes after Magistrate Nyakewa cancelled a Sh300,000 bond requested by the accused on the basis of applications filed by the prosecution.The prosecution argued that the accused might commit similar criminal activities once released. Rajab is facing four different criminal charges, with two of the charges involving fraud by obtaining money by false pretense. Rajab and others not present before the court are accused of obtaining Sh10,880 from Jeremiah Ndegwa Baya between May 26 and July 5 in Likoni by lying that they will secure him a job at the Kenya Prisons Service.On the second account, Rajab is accused of falsely obtaining Sh100,000 from Mwanaharusi Abdalla between July 19 and July 30, 2016 after promising him he will secure him a job at the Kenya Ports Authority (KPA). The hearing of the case has been scheduled for November 11, 2017.
