The High Court has suspended a bankruptcy notice against August 8th presidential candidate, Cyrus Jirongo.
Jirongo petitioned an earlier ruling by the court, which declared him bankrupt, by Commercial Court Judge Olga Sewe, who ruled in favour of his creditor, businessman Sammy Kogo.
Jirongo who was unable to pay a debt of Sh700 million, moved to court seeking suspension of the bankruptcy notice, to enable him contest in fresh presidential elections.
In a letter to Chief Justice, David Maraga, (dated 10th October 2017), the former Lugari MP dismissed media reports that he was served with a bankruptcy notice by the High Court.Jirongo said he had never been served with any decree, bankruptcy notice or other court proceedings“I have learned with shock from media reports that the High Court declared me bankrupt. I was taken by surprise by these media reports, which began trending yesterday evening as I have never been served with any decree, bankruptcy notice or other court proceedings," red part of the letter.
During the hearing, Monday morning, the High Court further directed Jirongo to file his defense about the same case, within two weeks.
Jirongo wanted his name to be included in the October 26th fresh presidential election, ballot, but IEBC dropped him, due to the bankruptcy case.
It is however not yet clear if he will now demand to be included, on the ballot. If this happens, it will be a huddle for IEBC, since it has already printed and received ballot papers for the fresh poll, from Dubai.
