Barrack Muluka will continue to serve as ANC Secretary General after the High Court ordered for his reinstatement.
Justice Lucy Njuguna set aside a judgement by the Political Parties Disputes Tribunal which nullified his appointment.
Muluka filed an appeal at the High Court after rejecting the tribunal's order that stated that Nominated MP Godfrey Osostsi was the rightful holder of the position.
Mudavadi, Muluka, Kelvin Lunani and Margaret Ndanyi had asked the court for orders against the execution of the tribunal's directive, pending the hearing and determination of the application.
“The application ... is urgent and needs to be heard on priority basis [as] the object of the application might well be defeated and the appellants are likely to suffer injustice and irreparable loss and damage [should the tribunal's orders be executed]..." Ameyo said.
Mudavadi claims that ANC members Angela Gathoni, Ibrahim Memba and Osotsi prematurely took the case to the tribunal.
