Starehe MP Charles Njagua has received a major boost in an election petition challenging his win.
This is after a Nairobi court dismissed an application by a petitioner Steve Mbogo to provide new evidence.
The court said Mbogo's lawyer, Edwin Sifuna, made the application after all the witnesses had testified in the case.
"By requiring the election materials be kept in safe custody, the law does not imply that the said materials had already become evidence," said Justice Fred Ochieng on Thursday.
The MP had opposed the application, arguing that the petitioner had not given any basis to warrant the exercise of the court's discretion.
According to The Standard, justice Ochieng further ruled that Mbogo failed to persuade the court that the justice of the case requires the orders sought.
"It is only when the court gives order for scrutiny, recount or retallying that the election materials can be accessed for the purposes specified in the court order," the judge added.
