Mavoko MP Patrick Makau has bailed out five NASA supporters arrested in connection to anti-election demonstrations during repeat presidential election in Athi River on October 26, 2017.

Amos Aura, Hezbron Mangete, Jackob Omondi, Maurice Zakayo and Joseph Musyoki appeared before Senior Principal Magistrate C. Oluoch at Mavoko Law Courts in Athi River Machakos County on Tuesday.

They were charged with incitement to violence and disobedience to Law contrary to Section 96 of the Penal code.

The court had that on 26th Day of October 2017 at around 10.30 am at Makadara Estate in Athi River Sub County in Machakos County, the five jointly with ten others not before the court were found to have unlawfully barricaded Athi River – Makadara Road with stones and poles while uttering words ‘No reforms, no elections’ in order to defeat by violence the casting of presidential votes at Athi River Primary School polling centre.

They had initially been exposed to cash bail of Sh20,000, Sh50,000 bond with surety of same amount which they failed to raise.

Makau intervened by bailing them out after the five spent 18 days at the Athi River GK Prisons in Kitengela  after their relatives failed to raise the money for their release.

The lots’ lawyer Yvonne Jerutto made an application for review of the bond and cash bail.

“I plead with the court to review the five accused persons’ bail and bonds to ensure their release from custody and allow them attend court from home,” said Jerutto.

Jerutto said nobody had tendered any evidence in court that the accused persons could abscond case in court.

“They have been in custody since 27/10/2017 and were not able to afford the bail, they request for fair cash bail from the court so as to proceed with the matter while outside court,” added Jerutto.

Judge Oluoch accepted the plea and reduced the cash bail to Sh10,000 for each suspect.

Oluoch said, “I have considered considerations for all the accused persons. For the sake of justice, I have reduced the bail for all the five accused persons to attend court while out on bond.”

Makau paid cash bail of Sh50,000 for their release, Sh10,000 each as directed by the court.

The case's mention scheduled for 24/11/2017 while hearing slated for 14/12/2017.
