Prof Mutua, a human rights activist and renowned lawyer faced the JSC interviewing panel after the High Court ordered the Judicial Service Commission to reconsider applicants who were left out during the shortlisting process.

And now Nairobi lawyer cum politician Steve Mogaka has backed the firm don for the top Judiciary job warning the JSC against discriminating him based on his political prejudices.

“It’s true that on matters law, we need someone with undisputable intellectualism and who can bring sanity to the Judiciary. A mind that calls a spade a spade and that is what Kenya needs,” he said.

“Mutua showed his distinction as a don and a true reformist and my prayer is that he gets the job. As a scholar, he may have made utterances that may not have gone down well with the State but that cannot be a reason why he should not be the next CJ,” he added.

Mogaka maintained that the don ‘out-classed’ earlier contestants who had been interviewed and predicted a major dilemma for the appointing authorities.

“He has already out washed those who were interviewed before and I see a major dilemma by the appointing authorities,” he said.

Mutua faced tough times explaining why he has never recognised President Uhuru Kenyatta as the legitimate Head of State.
