Academician and former Chief Justice candidate Professor Makau Mutua has defended Nairobi Senator Mike Sonko over treason accusations.

On Saturday, the renowned lawyer took to his twitter account where he dismissed accusations that Sonko had committed treason by calling himself acting president. Instead, Mutua said Sonko's sentiments were just a loose talk.

In Sonko's defence, Mutua tweeted.

“Nothing treasonous when Mike Sonko says he's 'acting president.' Harmless loose talk. Let's not go back to Njonjo."

At one time, Charles Njonjo a former powerful Attorney General announced that it was a criminal offence, “for any person to encompass, imagine, devise or intend the death or deposition of the President”.

Mutua was reacting to comments from legal minds who have been calling for the arrest of Nairobi Senator arguing that his remarks amounted to treason. 

Makau's argument was supported by flamboyant lawyer Donald Kipkorir. Kipkorir said Sonko's action did not meet the threshold of a criminal offence.
