High Court sitting in Nyamira is set to rule whether or not governorship elections can be subjected to scrutiny that will also include recount.
Ex-Kitutu Masaba MP Walter Nyambati, through Nyaencha Waichari and Company Advocates, had applied for vote scrutiny.
Last month, Justice Aaron Makau had expunged affidavits filed by Nyambati’s key witness, Bob Ndubi on grounds that it was not dated.
With voter tally being the epicenter of the case, Makau will on Monday decide whether or not to grant vote scrutiny.
On his part, Governor John Nyagarama had opposed recount adding that elections were free, fair and credible contrary to the petitioner’s argument.
During the August 8th elections, Nyagarama, a close ally of ODM leader Raila Odinga, was declared winner having garnered 65,161 votes to Nyambati’s 58, 936.
At one of his meeting with Gusii leaders prior to presidential repeat polls, President Uhuru Kenyatta had vowed to ensure the matter is ‘revisited’.
Nyambati, who was flying Jubilee flag, is a close confident of Uhuru given their past close relationship.
