A 65-year-old man was on Tuesday arraigned before a Kisumu magistrate court to face charges of raping a 14-year-old neighbouring girl.

Kennedy Munialo, however, denied the charges before Kisumu chief magistrate Thomas Obutu for the crime he is alleged to have committed on June 15.

He faced a second charge of assault, which he also denied.

The court heard that the accused, a resident of Mamboleo in Kisumu township, was caught red-handed in the act by the victim’s mother on the evening of June 15.

He is alleged to have committed the act at the victim’s house when he had gone to visit the father but found her alone at home.

Upon learning that he had been discovered, Munialo rushed and held the mother who was heading to the door to raise an alarm, the court heard.

According to the prosecution, the accused tried forcing them to remain silent but they refused, he ended up assaulting them. Neighbours were attracted by the commotion and came in to enquire what had happened.

They 'arrested' Munialo and frog-marched him to the Mamboleo police station. The victim was taken to hospital where she was treated and discharged.

Munialo, however, argued that the girl had sex with him after agreeing with him, but the prosecution said that the girl was underage, something not allowed by the law.

He was remanded in custody until July 29 for the hearing.
