In a case brought to court by the Directorate of Criminal Investigations in Kisumu, Makamu was charged of incitement to violence an act alleged to be committed during the demonstrations against IEBC by ODM supporters on Wednesday.

“Makamu on April 26 at ODM offices in Kisumu Central Constituency without lawful excuse uttered words ‘If Issack Hassan cannot defect or resign immediately the way the Chief Justice wants, Kenya will never be the same again. The Jubilee government should prepare for war like in Rwanda because ICC is nothing. People will fight in this country, people will die.’ Which words are calculated to bring death to Kenyan citizens,” read the charge sheet.

Makamu however, pleaded not guilty to the charges when he appeared before resident Magistrate Rose Ndombi.

Through his counsel Richard Onsongo, he asked that he be supplied with the investigation diary, witness statements, expert reports and any other exhibits that the prosecution intends to rely upon in the subsequent court proceedings.

He was released on a bond of Sh100,000 with similar surety with an alternative bail of Sh30,000.

The case will be heard on June 6.
