A middle-aged man accused of falsely presenting himself in Court as an accused person in an assault case, was charged with impersonation.

Benson Makau who appeared before Chief Magistrate Bernard Mararo, Thursday, was accused that on diverse dates between October 12, 2016 and January 25, 2017, falsely presented himself in Court as an accused person in an assault case to confuse witnesses. 

Makau was arrested by police officers after the investigating officer who was to testify on the assault case, told the Court the culprit was an imposter and not the accused whom he arrested. 

The prosecution told the Court the accused person had impersonated Solomon Kyalo who had been arrested and charged with grievous assault before a Nakuru Court. 

According to the police, Makau willingly stood in the place of Kyalo with intention to confuse the Court and the witnesses who would later deny knowing him. 

The Court heard that the accused appeared in all proceedings in the assault case and even responded when called by the name Solomon Kyalo. 

The accused who pleaded guilty to the charges was unable to explain why he presented himself as Solomon Kyalo in the matter. 

According to the prosecution, the assault case will have to begin afresh on grounds that the matter had already been compromised.
