A middle-aged man has been sentenced to serve 15 years in prison by a Mombasa Court for raping a blind woman.
Mombasa Senior Resident Magistrate Edgar Kagoni found Mr Kazungu Mwakamsa Kinango guilty of raping the 18-year-old woman.
The prosecution told the court on Tuesday that the accused, raped the woman who was his neighbour on April 18 at Inuka area Mombasa County.
Results from the doctor’s examination which were presented before the court indicated that the woman was indeed raped.
In his ruling, Magistrate Kagoni found the accused person guilty of the charges, saying the prosecution has proven its case beyond reasonable doubt.
Kagoni said there is circumstantial evidence indicating that the accused person committed the offense.
“From the evidence presented before this court, the accused person left his clothes in the house of the complainant while he was trying to escape from the premises. After examining the report from the doctor who conducted the DNA examination, I have found beyond reasonable doubt that the accused committed the offense,” said the magistrate.
In his mitigation, the accused pleaded with the court to pardon him saying he was a family man and his family's bread winner.
The magistrate, however, said the court has the mandate to ensure justice for the physically challenged is served, adding that incidents of cases relating to rape of disabled persons were on the increase.
