A man who raped a minor was arraigned before a Thika court to hear the ruling of the court.
James Munyao Mutisya 27, from Murera Ruiru had appeared before the resident magistrate Mercy Mutuko and pleaded innocent on 6th March this year leading to the hearing adjournment that was now heard today.
The charge sheet had indicated that Munyao had defiled the six year old minor after luring her through a hard cake enticement on 6th January this year and later took her to his rental house in Murera in Ruiru sub district and committed the heinous act.
He was later arrested on 7th January this year and charges against defilement filed against him.
The court prosecutor Nancy Muthuri produced the last witnesses in court who were a police officer and a doctor.
Beatrice Nyokabi the doctor from Mati All Hospital told the court how painful the six year old minor experienced after the course which according to her (the doctor) raptured her privates and this can lead to infertility.
Martin Magani told the court that the public shared the information them leading to the arrest of Munyao who has been in custody since January 9th this year.
Prosecution pleaded to the court to balance the evidence his docket had and give a fair ruling that would help rapists learn a lesson.
The magistrate considered the mitigation of the middle aged man that he was an orphan. She however handed the accused four years in jail with liberty to appeal against the ruling in fourteen days.
