A 27-year-old man was sentenced to life imprisonment after being convicted of sexual defilement to a seven year old girl.
Mutua Ndambuki, a resident of Ikombe location, Yatta Sub-county in Machakos appeared before Kithimani Courts Judge Denis Karani, with a case of defiling a seven year old girl from Ikombe, which is condemned by both the Supreme Constitution of Kenya and society values.
Ndambuki will spend the remaining years of his life behind bars following a morning hearing in Kthimani courts.
According to the witnesses, he lured the nursery school minor into the forest one evening, when she was coming from fetching water at a nearby river, where he committed the defilement. The incident happened in 2014 April.
After hearing the case, Denis Karani, the resident Magistrate of Kithimani Court handed the life imprisonment sentence after medical results presented by a medical practitioner tested positive to the accusation.
While making his ruling, the magistrate condemned the incident saying that rape and defilement of minors was an act of animosity, and not only leaves the children sexually hurt but also emotionally disturbed.
“You seem to lack any impression of a conscience. This court on this day finds the accused guilty of the accusation according to the evidence by the medical practitioner of prosecution witness that confirmed that the girls’ hymen was broken subsequently confirming the evidence,” ruled the Magistrate.
“The court is obligated by the law under section 8(1) (4) to convict the prosecuted for Sexual Offence Act,” the court ruled.
The parents of the minor, who were present in court were happy to see the man who took away their child’s innocence get what he deserved if not less.
