Mr. Mohamed Salah was being accused of allegedly raping the minor together with two others, not before the court.

The court heard that the accused together with two other suspects gang-raped the Form One student on February 18 and 19 this year in Habaswein Sub County in Wajir.

The prosecution told the court that the accused person picked the minor from school after he offered her a lift.

The court heard that the accused gave the girl a drink which he had spiked and the minor lost consciousness before she was raped by the three men.

The accused person, however, denied the charges before the court and filed an application to be released on bail pending the next case hearing.

Wajir Chief Magistrate Amos Muroka, however, dismissed the application and ordered that the accused be remanded in police custody for 10 days to allow the police to finish their investigations.

Magistrate Muroka further said that if the accused is released on bail, he risks compromising the victim’s parents leading to the collapse of the case.

The case will be heard on March 5.
