James Mbote, 37, from Gakoe in Kiambu County was charged that on March 17 this year, he was caught by a neighbor defiling a four year old in his home at Gakoe shopping center.

James Njoroge, who was among the witnesses, told the court that Mbote had tried severally to lure the little girl to no avail.

“He on the material date bought the girl a lollypop and invited her to his house where he committed the crime,” he said.

Njoroge further informed the court that the minor was warned against revealing the details of the crime to anyone, threatening to kill her.

The girl allegedly started suffering, and after he mother, Nancy Njoki, noticed, she took her to Gakoe Dispensary for medication.

She later told the mother what had happened, who reported the case at Gakoe police station and the accused was arrested.

The prosecution told the court that it was not the first time for the accused to be involved in the act, having been accused before of defiing a similar aged girl, who is his cousin, but was released on grounds of lack of enough evidence.

Mbote, who appeared before the resident magistrate Mercy Mutuko pleaded innocent and requested for evidence.

The magistrate handed him Sh300,000 cash bail and ordered the case to continue on May 30, 2015.
