A 40-year-old man accused of illegally being in possession of a pistol was on Monday arraigned before a Kisumu Law Court to answer the the charges.

Victor Mogere however denied the charges before Kisumu Chief Magistrate Lucy Gitari for the offence he allegedly committed in Kisumu’s Mamboleo Estate.

Mogere was arrested by Police last week on Thursday in Mamboleo with a pistol without its licence as required by the Kenyan law.

The Police are yet to establish his intentions. He was arrested at a Mamboleo Junction roadblock.

The Prosecution Desk told the court that the accused has bad criminal record and they suspected the weapon in his possession was probably meant to carryout crime.

The Prosecution Desk applied that the accused be remanded in Police custody saying that he is a threat to security of other innocent Kenyans.

The Prosecution Desk also argued that investigations are still on going and therefore it would be unwise to set the accused free as he might tamper with the progress of the investigators.

Magistrate Gitari denied Mogare bail due to validity of the Prosecution Desk’s reasons.

“The accused is denied bail because the reasons given by the Prosecution are valid, since security of other innocent Kenyans can be jeopardised if the accused is set free,” said Magistrate Gitari.

Mogare was remanded for one week and the case will resume on Monday next week when investigations shall have been completed.
