The complainant Martha Mutahi told the court the that she had been married to Joseph Mutahi for six years,  but that he had stopped caring for her and their two children ever since January 2013. Mrs Mutahi told the court that she was jobless and she is now struggling to provide for her children.

Mrs Mutahi also told the court that she has tried to pressure her husband to pay school fees and to provide for other basic needs, but to no avail. She called her husband arrogant for not taking care of her and her children, despite him having a well-paying job as an accountant.

“I seek directions of the court for my husband to provide the basic needs and pay school fees for the children. I still love him but he makes me suffer with the burden of raising the children alone,” Mrs Mutahi protested.

The prosecution told the court that the accused person should be compelled to maintain his family. The prosecution also sought that the accused should make a declaration to commit him, as required of him by the marriage act.

The court set a hearing date on February 25th to determine the case.
