Peter Amuoma is accused of intentionally and unlawfully defiling a young girl named aged eight, on November 10 2013.

The accused is said to have lured her into a maize plantation, after which he severally defiled her.

The court heard that the accused was a well-known friend to the minor, and she never expected to experience such an ordeal with him.

Nyakundi was then arrested on November 11 2013, after neighbours reported alarmed the Kisii Police officers.

Senior Magistrate L. Kaitany remanded him in custody until his further hearing on a later date.

In his ruling, the Magistrate said that defilement is contrary to section 8[1] as read with section 8[2] of Sexual Offence Act No. 3 of 2006.

Initially, the court had ordered for a medical checkup to ascertain the accused’s age and the reason as to why he was involved in such indecent act.

From the results signed by the medical superintendent of Kisii Level Five hospital, no abnormality signs were traced.
