A man has been arraigned in a Thika court and charged with different offences including forgery.

Michael Kiboko Thuo is accused of making an official document and a court order to authorise disbursement of funds of a diseased man to his purported beneficiaries.

The accused pleaded not guilty to all the counts when he appeared before Chief Magistrate Stephen Mbungi.

The court heard that the accused presented himself to William Ng’ang’a and Nicholas Eliud, sons of the late John Gitonga, as an advocate specialising on issues of succession on February 3, 2012. The two were allegedly soliciting help to start legal procedures to get their late father’s dues from Mukomboki Tea Company. The accused person forged the document at an unknown place where it was presented to the company for the release of the dues of the late man’s sons.

The accused had allegedly agreed to charge Sh60,000 shillings to start the legal procedure which the two brothers paid.

Thuo later forged a court order advising Mukomboki tea factory to release the dues of late John Gitonga in the company to the purported administrators. The court order bore the signature of a senior Magistrate Bernard James Ndenda who worked at the courts before being transferred.

This led to the tea company releasing a total of 1,676,444 shillings to the two brothers. The company later learned that the court order was fake and decided to question the brothers who had no idea as they had also been served with the court order by their alleged advocate.

The prosecution asked the court to remand the accused for two working days to allow the completion of an ongoing investigation.

The case continues tomorrow, October 10.
