A 30-year-old man charged with killing his mother has been sentenced to 33 years imprisonment by a Mombasa court.
Mombasa Chief Magistrate Julius Nang’ea found Mr Joseph Kiora Syengo guilty of killing his mother by stabbing her twice on the neck.
The accused was facing charges that between September 21 and 23, 2014 he killed Ms Elizabeth Kisia Syengo at Dongo Kundu in Likoni, Mombasa County.
The accused was also facing a second count of assaulting his brother Mr Musyoki Syengo and causing him bodily harm.
The prosecution led by State Counsel Lydia Kagori told the court that the suspect on the said date cut his mother with a panga twice on the neck while in his house.
The brother, Mr Musyoki who had gone to help their mother was also attacked by the accused with a panga and he was cut on the neck and on his chest before the accused person went into hiding.
The suspect, who admitted to killing his mother, asked the court to forgive him saying he had no past criminal record adding that he acted under grave provocation and was defending himself saying the mother had tried to recruit him to inherit her witchcraft and had asked him to commit an act of incest with her.
Magistrate Nang’ea however while making his judgment noted that Mr Syengo’s act was motivated by anger but was not excusable from punishment.
“I have noted the mitigation of the accused, he was a close relative to the deceased, he must be severely punished for brutal attack on the deceased, I sentence him to serve 33-years imprisonment,” ruled the magistrate.
The accused person was handed 30 years imprisonment for the offence of manslaughter and three years for assault and the sentence will run concurrently.
