A Mombasa Law Court has sentenced a middle-aged man to five years in prison for sodomising a mentally challenged man.
Mombasa Chief Magistrate Susan Shitubi found Mr Ibrahim Ramadhani guilty of sexually assaulting a 29-year-old mentally challenged man.
The prosecution told the court that the accused committed the offense on October 30, 2015 at Shelly beach, Likoni, Mombasa County.
The prosecution further said that Mr Ramadhani forcefully grabbed and sodomised the mentally challenged man while he was strolling along the shoreline.
The accused was arrested by Ferry police officers and was charged in court with committing an indecent act with an adult.
During the case hearing, the court heard that the accused was positively identified by the mentally challenged man’s mother.
Medical reports from Coast General Hospital produced before the court confirmed that the complainant was indeed sodomised.
The accused who denied the charges before the court had asked the court to forgive him claiming he is an orphan and that the case had also affected his health.
Magistrate Shitubi in her ruling found the accused guilty of the charges saying the prosecution has proven its case beyond reasonable doubt.
“The court finds the accused guilty of the charges after four witnesses testified in court and there is no reasonable doubt,” said Shitubi.
The magistrate gave the accused 14 days to appeal against the sentence.
