A Kisumu man has lost a half an acre piece of land for failing to pay for his child’s upkeep.
The man identified as JFM in court documents to protect the identity of the child was required to pay Sh10, 000 monthly for the child’s upkeep after he divorced with his wife.
Court documents refer to the former wife as SAO. JFM and SAO were married between 1999 and 2003, before they divorced.
In 2006, JFM was directed to make the monthly payments after their marriage ended, but he defied the court.
The court heard that the accused colluded with another person who bought this land, in order for him to evade paying the monthly upkeep to his child.
Kisumu High Court Judge Stephen Kibunjia ordered that the title deed of the land be reverted to the name of the woman, in order for her to use the land for the child’s upkeep.
“The second defendant was not an innocent purchaser of the suit land for value, but an active participant in the first defendant (JFM) machination to evade or avoid the attachment of the rental income arising from the suit land as ordered by the Children’s Court on the August 5, 2015,” said the judge in his ruling as quoted by the Standard.
He added, “The transfer of the suit land by the first defendant to the second defendant was aimed at defeating the cause of justice and must be frowned upon by not only this court but also all law abiding citizens and institutions.”
