The court’s decision to place Ernest Kariuki on probation was reached after the Kiambu probation office tabled proof that the accused is fit to serve the 12 months service term sentence.

Kariuki is accused of assaulting AP officer, Thomas Muvengei, on June 28 in Kiamumbi, Kasarani division, occasioning him actual bodily harm.

The court heard the law enforcer was on patrol by foot with other officers when they found the accused smoking an outlawed drug (bhang) and upon police request to surrender himself, he allegedly turned violent and hit the complainant on the mouth using his head, thereby causing him severe injury.

During the attack, the accused was allegedly already handcuffed by police officers and it was in his defence that he attacked the security officer.

He ostensibly injured the plaintiff’s upper front teeth which became loose and his lower lip was also injured.

Kariuki was also, allegedly, found with five rolls of bhang in his trousers’ right pocket.

After considering the probation report, Kiambu principal magistrate Diana Mochache sentenced the accused to serve the 12-month probation failure to which he will be re-arraigned in court.
