Machakos Law court’s Justice Nyamweya slapped the man with the jail term after the case dragged since 2013.
The girl told the court that the mother had gone to wash clothes before the man committed the heinous act which left residents in deep shock.
The girl went on to narrate that he locked the door before he committed the offence.
“My mother had gone to wash clothes at a nearby river when my father summoned me to the house. He locked the door and threw me down and lay on me," she narrated.
The defiled girl also revealed that she was ready to leave for school, but the father asked her not to go only to encounter one of her worst experiences in life. The minor further noted that the man had promised to buy her bread and avocado.
“He promised to buy me bread and an avocado if I oblige. We stayed in the house up to about 10.00am, then he gave me porridge to take, she told the court. It was also found out that the man had defiled her on several occasions.
In his ruling Justice Nyamweya upheld that the man was guilty of the offense. “Given the tender years of the complainant and the fact that the appellant abused his position of trust in relation to his child, he deserves a deterrent sentence,” he ruled.
