A man serving a life sentence was on Thursday charged before a Mombasa Court jointly with two others with the murder of an Asian.Mr Aden Siiba who is serving a life sentence at the Malindi GK Prison for robbery with violence was charged alongside Mr Abdulkarim Ali and Ms Julie Mwamuye.The three are accused of killing Mr Moiz Esmail whose body was found dumped in Bombolulu.The court heard that Esmail was reportedly kidnapped at gunpoint while heading from a mosque in Old Town area before he was found killed on November 11, 2017.The prosecution told the court that Esmail’s kidnappers had demanded Sh2 million as ransom and the family had sent Sh300,000 only to find out that he had been killed.Siiba’s lawyer Eugene Nabwana told the court that his client was being mistreated in prison.Nabwana told Judge Dora Chepkwony that Siiba who is suffering from diabetes and high blood pressure is being kept in a hole at Shimo la Tewa Prison.He said Siiba has been disintegrated from other remandees and only gets out for a few hours.State prosecutor Yamina Jami, however, said that the prison's administration has privileges on how it conducts its business, adding that the law allows the commissioner of prisons to separate a remandee.Judge Chepkwony ordered the accused persons be taken for a mental assessment before they take a plea.The case will be mentioned on December 13, 2017 where the three are expected to take a plea.
