Stanley Kang’ethe, who was brought before resident magistrate Esther Mburu, was accused that on August 3, 2013 at Kiangage village in Thika East sub-County, he defiled the class one pupil kid (name witheld for legal reasons) at St Joseph Kiangage primary.

The minor said that she was at home when Kang’ethe came, took her to the bush, removed her clothes performing the indecent act.

The first witness, Esther Gachoche, told the court that she was going to school when she saw the victim returning home from school in the morning.

"Seeing her I got concerned since she was walking with difficulties. On arrival at school I sent her brother to go and check on her, he returned and said that she had soiled on herself," she said.

“Later [she] returned to school at around 10am and appeared to be walking with difficulties. I questioned her and it is then when she disclosed to me on how she had been defiled again and how she had been threatened not to reveal the incident to anyone," the witness said.

Monica Njai, the mother of the girl, said that she was at home in the morning when she received a call from the school to go and collect her daughter who was unwell.

“I proceeded to school and was informed that my daughter had been defiled, I reported the matter at the Makongeni police station and we were referred to Thika level five hospital where she was examined and treated and the doctor completed the P3 form.

The magistrate found the accused guilty of the charge and sentenced him.
