The resident, Hamiliton Mwakitele Mwalongo, has also filed a suit against the Independent Electoral and Boundaries Commission (IEBC) under the chairmanship of Wafula Chebukati, for clearing Omar to participate in the Mombasa gubernatorial race.
On Friday, the resident, through his lawyer Jesse David Odoury filed the petition seeking to bar MPs and senators who are yet to resign from contesting in the forthcoming general election.
Addressing journalists in Mombasa, Oduory said leaders who have not resigned from their current positions are not fit to vie in the upcoming polls.
He, however, said his main aim is to protect the Constitution and not just to bar the Senator from the race.
“We want to let the public note that the constitution does not allow state officials to contest the governor positions,” he said, as quoted by Baraka FM.
Omar is seeking to unseat Governor Hassan Joho of ODM on a Wiper party ticket.
Others in the race include Suleiman Shabhal (Jubilee) and Nyali MP Hezron (VDP).
