A court in Nakuru on Thursday morning acquitted a 40 year old man who had been charged with maliciously killing his neighbor’s dog. Senior Resident Magistrate Patrick Mwaniki set Antony Kimemia free after the prosecution failed to produce sufficient evidence for the third time as the complainant failed to appear in court. According to the charge sheet, the accused is said to have attacked Mr. Moses Wanyoike’s male dog after it strayed into his compound using a sharp weapon and inflicted serious injuries on the domesticated beast on 26th December 2012 at Moronyo village in Bahati Nakuru County. The court also heard that the accused later poisoned the dog to death using an unknown poisonous substance by applying it on pieces of meat which he threw on the fence that separates his compound and the complainant’s. According to the prosecution during the hearing on March 20th 2013, the accused had earlier complained that the dog was a nuisance as it was causing havoc by invading his home and devouring unguarded goat meat in the kitchen that his family had slaughtered during the Christmas holiday celebrations. The accused had however during the mention of the case denied the accusations and released on a Sh30,000 bond.
