A man who appeared in a Thika court for allegedly raping a 24 year-old girl denied the charges terming the girl in question as his wife. He told the court that the woman in question engaged in sex willingly and further asked the court to free him as the investigation is done, which prosecution objected. John Muraya, 37, from Makwa in Gatundu South Sub County appeared before Resident Magistrate Nancy Mutuko. The court prosecutor Inspector Ali told the court how Muraya committed the heinous act on April 24, 2015 in Makwa at the woman's house. It is said that the accused was a good friend to the woman but both were engaged in a love conflict where he wanted to marry the woman but she refused. Catherine Muthoni a neighbor told the court that on the evening of April 24, Muraya went at the home of the complainant as a friend and had dinner with her. It is after a sexual urge request made by Muraya that a standoff broke and he beat her before forcing her to have sex with him. The complainant reported the matter instantly to Makwa police station and was advised to go for a medical check up. She went to Gatundu District hospital where she was found to have fertilised an ovum. The doctors advised her to abort since it was not her wish but she opted to remain with the unborn to act as evidence in court. According to prosecution, Muraya after realising his mistakes went underground until April 28, 2015 when Makwa police arrested him as he was meandering in Makwa shopping centre. He was released on Sh 450,000 or an alternative cash bail of Sh 300,000. The case will be heard on August 11, 2015.
