Chief Justice David Maraga has been warned against siding with the Judiciary over the National Resistance Movement (NRM) leader Miguna Miguna saga.

In an interview on Radio Jambo Saturday, Kikuyu lawmaker Kimani Ichungwah accused Maraga of protecting his juniors, taking issue with his recent counter on Interior Cabinet Secretary Fred Matiang'i who accused the body of siding with the opposition to embarass the state.

Matiang'i had questioned the move by a section of judges to issue court orders directing him to appear before court over Miguna's prevention from entering the country in his absence, claiming that the same was a collusion between the judges, lawyers and opposition activists to victimize him, claims that Maraga has since trashed.

According to Inchung'wa, the Chief Justice is out to protect his officers from taking blame, vowing to strongly oppose what he termed as a plan to to put the judicial arm of government over its executive and legislative counterparts.

''Maraga should drop his bid to make the Judiciary seem above the other arms of the government. We are not going to allow one arm to overlook the others by issuing bias rulings,'' he said.

In a quick rejoinder, however, former Makadara Member of Parliament defended the CJ, noting that he is not to blame for the judges' independent decisions.

According to the ex-lawmaker, they should be independently held accountable should it be established that they indeed contravened the law.

''Maraga is not to  blame as he has no power over individual judges' rulings. The judges have to shoulder the blame should they be proven guilty,'' he said.
