Supreme Court has responded to IEBC chairman Wafula Chebukati with regards to the October 26 repeat polls.
Last week Chebukati wrote to Chief Justice David Maraga seeking clarification on whether he can correct errors on Form 34Bs. Chebukati said there is confusion because, as noted by the top court, he cannot alter results as announced at constituency level.
"Despite agreeing with the finding in the Maina Kiai case, at paragraph 294 of its judgment, the Supreme Court criticised the IEBC over errors identified by the court," said Chebukati.
The IEBC chairman is set to receive an answer to his querry after the Supreme Court said it will hear Chebukati's application seeking clarification on whether he can edit poll results in Form 34Bs on Wednesday.
"This court will reconvene on Wednesday the 11th October at 10am," Maraga said.
Maraga has issued three orders on the case before it is heard on Wednesday, first he ordered IEBC legal team to file a detailed submission which should be served to the other parties by close of business on Monday October 9.
The Chief Justice also ordered that other parties including NASA leader Raila Odinga and President Uhuru Kenyatta should file their submission by close of business on Tuesday.
In his application last week, Chebukati asked the Supreme Court to hear the case as a matter of urgency before the October 26 repeat polls.
